Rahul
sentenced to jail over Modi remark
AHMEDABAD:\
A lower court in India convicted opposition leader Rahul Gandhi on Thursday to
two years in jail on charges of defamation for a 2019 speech in which he
referred to robbers as having the surname Modi.
Although
Rahul Gandhi plans to challenge the ruling in a higher court, any jail time or
expulsion from the House of Representatives would be a setback for the Congress
party in the run-up to the general election in 2024, which Prime Minister
Narendra Modi's party is widely
predicted to win.
A magistrate's
court in the Gujarat state capital of Surat—hometown—issued Modi's the ruling.
An elected official from Modi's Bharatiya Janata Party from Gujarat filed the
lawsuit (BJP).
The
52-year-old political heir to the Nehru-Gandhi dynasty, Rahul Gandhi, was
present when the Surat court instantly granted him bail and suspended the
sentence for one month.

Varma, the chief judicial magistrate of Surat, stated in his order that
"Accused Rahul Gandhi is adjudged guilty... and sentenced to two years'
simple imprisonment."

Gandhi’s comment scandalous. "
According
to Kanchan Gupta, a federal government adviser, Gandhi could be immediately
expelled from parliament following the conviction, in accordance with a 2013
ruling by the nation's highest court.
Congress
spokesperson and top lawyer Abhishek Singhvi told a news conference that the
party believed Gandhi may be disqualified.
The
stay of conviction is necessary for the disqualification issue, he explained. Any
reasonable system would give a person sufficient time to take some legal way to
stay the conviction," he said." "Any reasonable, fair,
non-oppressive, non-biased system."
Rahul
Gandhi mentioned the prime minister and two wanted Indian businessmen with the
surname Modi in his address prior to the most recent general election in 2019
when discussing alleged high-level corruption in the nation.
Gandhi,
a powerful MP and former Congress president, told the court on Thursday that
his remark was not directed at any particular community.
Congress
members came together in support of Gandhi, and numerous state organisations
planned demonstrations for later today and Friday.
Congress
president Mallikarjun Kharge claimed on Twitter that "the Modi government
is a victim of political bankruptcy." We'll file an appeal with a higher
court.
The
public and the opposition have a duty to inquire. The leader of the AAP and
Chief Minister of Delhi, Arvind Kejriwal, posted on Twitter that he respected
the court but disagreed with its ruling.
Gandhi's
once-dominant Congress now holds less than 10% of the elected seats in the
lower house of parliament and suffered crushing defeats to the BJP in the most
recent two general elections.
